Terms and Conditions

  1. Goods comply in all respect to local authority local Council and BSA or BCA requirements and have obtained all necessary approvals and certificates. If the Customer suffers any damage or loss as a result of a breach of this warranty, the customer shall be solely liable for any loss or damage suffered and the Customer agrees that it shall not make any claim against Katherine Solar NT for any loss or damage suffered as a result of the breach of warranty. The customer warrants that any improvements upon which the Katherine Solar NT shall be installing any.
  2. If Katherine Solar NT has not completed the works within four (4) months from the date of the Agreement, the Customer can terminate this contract or provide an extension of time to Katherine Solar NT for the completion of the installation. 
  3. Deposits paid are not refundable, unless is cancelled by Katherine Solar NT
  4. Technology Certificates (REC’s/STC’s) value. Katherine Solar NT agrees that the quote provided by Katherine Solar NT shall be based on the REC’s/STC’s price at the time of quoting and the parties agree that for the purposes of this Agreement the REC’s/STC’s price shall be fixed for a period of 7 days from the date of the quote. Katherine Solar NT reserves the right to amend the amount of the quote if this is not accepted by the Customer within this 7 day period. 
  5. The overall sale price is dependent on the Renewable Energy Certificates / Small-scale.  After installation, the Customer agrees to sign over the REC’s/STC’s incentive to Katherine Solar NT
  6. The REC’s/STC’s incentives value is based on the current Renewable energy target program from the Australian Federal Government. The Customer acknowledges that the REC’s/STC’s and other government incentives currently offered are subject to changes at the discretion of local authorities and/or state or federal government. The parties agree that Katherine Solar NT shall not be liable for any loss or damage that the Customer may suffer as a result of any change in the laws in place at the time of this agreement. 
  7. In the event that the installation of the goods by Katherine Solar NT requires a change to the existing inverters or the voltage as a result of the consumer loading or network loading and further work is required to be conducted by Katherine Solar NT, the parties agree that Katherine Solar NT shall not be liable for any costs associated with effecting the changes and shall be entitled to charge the Customer additional charges for the work conducted. 
  8. This Agreement is conditional upon the distribution consenting to the Network Agreement Application Form that shall be lodged by Katherine Solar NT on behalf of the Customer. In the event that the distributor denies the application, Katherine Solar NT reserves the right to retain the costs incurred by Katherine Solar NT to date for application fees. Any other monies paid hereunder shall be refunded to the Customer. 
  9. The Agreement is further conditional upon the Customer’s system complying with all applicable laws and regulations, including the Electrical Safety Act and associated Regulations. In the event that the Customer’s system is not compliant with these laws and regulations, the Customer agrees that it shall be responsible for and liable for all costs associated with ensuring that the system is compliant prior to commencement of the works by Katherine Solar NT.
  10. Asbestos: In the event that the Customer has asbestos in their property, in particular asbestos in? Or around the switchboard, that Katherine Solar NT is required to work on or replace, Katherine Solar NT agrees to conduct the electrical works in a safe and approved manner and bag the asbestos material. However, the Customer shall be solely liable and responsible for the disposal of any asbestos materials and will agree to sign an Asbestos work Form as required by Katherine Solar NT prior to commencement of any work. The Customer further agrees to pay any additional cost incurred directly due to the presence of asbestos and shall accept all risk and indemnify Katherine Solar NT for loss, damage or injury suffered arising either directly or indirectly due to the presence of asbestos on the Customer’s property. 
  11. Damage to property: Katherine Solar NT agrees to pay for any physical damage that is caused by its employees, contractors or agents to the property of the Customer in installing the goods on the Customer’s property that is not required for the purpose of completing the installation. This is limited to a 12 month period from the date of installation. 
  12. Acceptance of Terms and Conditions of Sale: This Agreement supersedes any earlier terms and conditions of the sale wherever publishes or applying between Katherine Solar NT and the Customer, and shall be deemed to override all oral and written agreements and negotiations by either party prior to the making of this agreement. 
  13. Prior Representations: Any oral representation, warranty or promise whatsoever (other than those contained herein) made by any employee, contractor or agent of Katherine Solar NT to the Customer does not form part of this agreement nor the basis of any collateral contract. 
  14. Retention of Title: No title to the goods shall pass to the Customer by reason of delivery of the goods to the Customer’s premises or the installation of the goods or the acceptance by Katherine Solar NT of the Customer’s request to purchase the goods or for any other reason until such time as payments in full of all amounts owing has been received by Katherine Solar NT and the REC’s/STC’s are assigned to Katherine Solar NT. Katherine Solar NT is entitled to take possession and dispose of any goods supplied by Katherine Solar NT to the Customer as they see fit at any time before title vests in the Customer. 
  15. Risk in Goods: Notwithstanding anything to the contrary contained in this agreement, all goods shall be at the risk of the Customer from the time that installation of the goods in or on the Customer’s premises has been completed. 
  16. Alteration: In the event that Katherine Solar NT is unable to supply the same product that has been quoted to the Customer due to supplier restrictions, Katherine Solar NT agrees to provide a similar product of equal or better quality than the product for which the quote was provided. If Katherine Solar NT is unable to obtain a product of similar or better quality, Katherine Solar NT shall reduce the price of this contract in accordance with the difference of price between the respective products supplied. Katherine Solar NT shall advise the Customer if there any replacement of product under this clause.
  17. Delivery Times: Any time quoted for delivery are estimates only, involving no contractual obligation and Katherine Solar NT shall not be liable to the Customer to make good any damage or loss whether arising directly or indirectly out of the delay in installation and commissioning. Time will not be of the essence for any installation and commissioning. Katherine Solar NT may notify the Customer of any delay in writing at its earliest convenience. 
  18. Delivery: Where the Customer requests delivery to any site, including the customer’s premises, Katherine Solar NT can elect to deliver the goods to that location but, if the location is unattended at the time of delivery this will not prejudice any of Katherine Solar NT’s rights in any way, nor will they constitute a waiver of any of Katherine Solar NT’s rights. 
  19. Force Majeure: In the event of a “force majeure” event, Katherine Solar NT shall be entitled either to rescind the Agreement (without being liable for damages) or to extend delivery or time for performance by a reasonable period or not less than the duration of such event and all liability under any contract, including liability for damage whether specified or otherwise, shall be modified or adjusted accordingly. “Force Majeure” shall include all happenings beyond Katherine Solar NT’s control or in consequence of which Katherine Solar NT is hindered in executing its obligations and shall include all strikes, trade disputes, fire, floods, other natural disasters, accidents, and supply, import or export delays. 
  20. Disclaimer of Liability: Katherine Solar NT shall not be liable for any expense, loss or damage of whatsoever and whether direct, indirect or consequential caused by or contributed to by any error, misrepresentation or misleading information supplied by or contained by manufacturer’s or supplier’s packaging, labels, specifications, brochures, pamphlets, advertising or other media. 
  21. Indemnity: The Customer shall indemnify Katherine Solar NT against all claims, costs and liability arising out of any infringement or alleged infringement of any law or the rights of any third party, including without limitation any copyright, patent, design or formula in connection with the supply of the Customer’s request or specification. 
  22. Warranty: Except for such conditions or warranties as are required by law , no condition, warranty or representation of any kind is given by Katherine Solar NT to the Customer whether in relation to the condition or suitability of the goods and all warranties, conditions and representations are hereby excluded to the maximum extent permitted by law. Furthermore, Katherine Solar NT ‘s liability for the breach of any conditions or warranties is limited to the replacement of the goods or supply of equivalent goods or repair of the goods or payment of the costs of such replacement, supply or repair. The Customer acknowledges that, except as aforesaid, Katherine Solar NT is not liable for any cost, expense, loss or damage of whatsoever nature, whether direct, indirect or consequential, caused by or resulting from breach of any conditions or warranties. 
  23. Jurisdiction: The Agreement shall be deemed to have been entered into in the Northern Territory and the Customer agrees to submit to the exclusive jurisdiction of the courts of Northern Territory. 
  24. Severance: If any terms in this Agreement shall for any reason be declared or become unenforceable, invalid or illegal for any reason, the other terms and provisions in this agreement shall remain in full force and effect as if the agreement never included the unenforceable, invalid or illegal terms. 
  25. No Waiver: Any failure by Katherine Solar NT to exercise or delay in exercising any right, power or privilege will not operate as a waiver of any such right, power or privilege. 
  26. Variation of Agreement: No variation of or addition to this Agreement will be binding unless produced in writing and signed by both parties hereto or their duly authorised representatives. 
  27. Notices: Any notice or other notification required to be given under this Agreement must be in writing and will be deemed duly served three days after it is mailed postage prepaid or by registered post or by security post, or one day after transmission by facsimile by either party to the other party as its address shown herein or last known business address or relevant facsimile number. 
  28. GST: If and to the extent that any payment or other consideration to be made or furnished by Katherine Solar NT to a person other than the Customer, pursuant to or in connection with this Agreement, may be increased or added to by reference to (or as a result of any increase in the rate of) any GST for which Katherine Solar NT is not entitled to receive and retain an input tax credit (as defined in A New Tax System (Goods and Services Tax) Act 1999), the Customer shall pay to Katherine Solar NT on demand an amount equal to that increase or the value of that addition. 
  29. Customer Warranty: The Customer warrants for the benefit of Katherine Solar NT that any and all? Information provided by the Customer to Katherine Solar NT in connection with any order to purchase the goods is true and correct. If in the event that Katherine Solar NT relies upon such information and if Katherine Solar NT suffers loss or damage as a result of that information being in any way materially false or incorrect, the Customer indemnifies Katherine Solar NT for such loss or damage including consequential? Loss suffered by Katherine Solar NT
  30. Katherine Solar NT may ask for a small initial deposit upon agreement of terms, this is to cover Power & Water application. A further amount may be due before installation and remainder of invoice due on completion.

David Kemp

Apprentice Electrician

David is a born and bred Katherine local who brings an element of diversity to the team as a qualified Air Conditioning and Refrigeration Mechanic who is now looking at commencing an Electrical Apprenticeship with aspiration of being a qualified A Grade Electrician. David’s distinctive skill set, sets him apart and compliments our team by providing diversity within the business.

David is a proud family man, on the weekends at home you will find him fishing, hunting and riding motor bikes with his son. 

Blake Johnson

Apprentice Electrician

Blake has joined the team with plenty of life experience under his belt as he is a Boilermaker by trade but has decided to expand his knowledge and gain new skills by taking on an electrical apprenticeship with Katherine Solar NT

When Blake isn’t busy studying or getting practical experience you will find Blake on a boat wetting a line and being social with the boys.

Jamie Walker

A Grade Electrician

Jamie has joined the team as a proud local, born and bred in Katherine NT. He has joined the team as a qualified A Grade Electrician who has recently returned home after a few years in Canada after deciding to head back home to be closer to family. Jamie has discovered a new found passion and drive for renewable energy storage and thrives on learning and evolving much like the solar industry.

In his spare time, you will find Jamie listening to his favourite country music and catching up with family and friends.

Dane McGennisken

A Grade Electrician

Dane joined the team as a Darwin based A Grade Electrician with over 10 years of experience under his belt. Not long after he completed his Apprenticeship he found his drive for Solar and renewable energy sources where he has consistently pursued his passion. Dane brings a wide range of diversity to the team with experience from Gas Plant works through to on and off grid systems residential and commercial installations.

When Dane isn’t at work, he is a proud family man who loves exploring the NT and watching his favourite footy team or designing a new clothing range.

Sam Pratt

A Grade Electrician

Sam has extensive experience in on-grid residential solar installation and with solar farm set ups. He possesses a broad range of knowledge and experience in domestic electrical, marine and industrial through to Oil and Gas. In recent times, Sam has enjoyed working on a variety of projects from self-sufficient caravan set ups through to solar bores and ground mount systems. His passion hasn’t always been around solar, he also possesses a passion for mechanical electrical and audio-visual wiring making his skills unique and imperative to our organisation.

Sam is a family man who in his spare time enjoys spending time with his family and friends be that outdoors on the water, he loves what the NT has to offer.

Luke Donohue

A Grade Electrician

Luke has worked in a variety of industries all relative to electrical from Navy boats to the Oil and Gas sector. Luke brings an enthusiasm for fault finding and a new found passion for micro inverters and battery set ups. With his previous experience, Luke has a new found interest, we now find Luke enjoying hybrid and off grid set ups.

When Luke isn’t at work, he spends his time hunting, fishing and living off the grid be that in the 4×4 and camping.

Sandesh Lamsal

Electrical Engineer

Sandesh joined the Katherine Solar NT team as a qualified Electrical Engineer who has extensive experience with exposure in Nepal through to Australia. His experience isn’t limited to just on grid-connected and off-grid systems; he is suitably experienced in CAD drawings and system simulation. Sandesh is responsible for all of the systems designs, assessing load profiles & energy storage requirements, system performance overview and ensuring the system is fit for purpose.

He has done Master of Engineering in Energy Planning and Policy from University of Technology Sydney, and provides Katherine Solar NT with a genuine point of difference with his expertise.   

In his spare time, Sandesh enjoys swimming, travelling and spending time with his friends.

Summa O'Dwyer

Systems Manager

Summa co-ordinates all steps of the process with the client and keeps everyone informed. She is responsible for lodging all engineering and supplying authority solar applications.

Summa has a background in safety development, data processing and project management. This is such as asset to Katherine Solar NT and it brings together all the necessary components to help run a smooth operation.

Summa loves camping with her family and having a cold beer with her friends and family around a BBQ.

Jake Groves

Director

Jake directs and controls the company’s operations and gives strategic guidance. He oversees and co-ordinates day to day operations. Jake is responsible for the installation process and co-ordinating all aspects of the project. Jake oversees the installation from the initial stages through to commissioning and manages the after-care service.

Jake is an Electrician and Standalone Solar Designer/Installer. Jake’s background as a Commercial Electrical Project Manager/Supervisor enables him to see a project through without hiccups.

Jake enjoys fishing, hunting, and his specialty of slow cooking and smoking beef and ribs have all his mates regularly coming around to the office for a feed.

Leigh Fowkes

Director

Leigh develops and implements plans and objectives for the company in an effective and innovative fashion. He maintains compliance with external regulations and internal policies. He identifies the clients’ needs and works with cutting edge technology to create a customised system. He is also responsible for product and supplier selection. This enables Katherine Solar NT to always have the latest and greatest products to offer their clients.

Leigh is an Electrician and Grid-connect Solar Designer/Installer. His background as a Commercial Electrical and Solar contactor makes him a great asset to the team.

Leigh enjoys fishing, camping with his family and flying.
